To the Trustees of Trustees Incorporated Under the Trustees (Perpetual Succession) Act, Laws of Kenya.
Please note that following publication of a public notice by the Ministry of Land on local dairies on November 2009 all incorporated trust (those that have the words "registered trustees" or "trustees registered" as part of their name shall be required to file returns with the Ministry of Land within 30 days from the date thereof. This notice has been issued pursuant to section 6(3) and 16(3) of the Trustees (Perpetual Succession) Act.
Although this notice does not provide the form that should be used for filing such returns, the information required to be filed include:
(a) the name and postal address of the current trustees;
(b) the physical address of the corporate body;
(c) the current activities being undertaken by the trust;
(d) financial statement including the source of funding;
(e) particular of any land vested in the trust; and
(f) statement that the trust is not being used for personal gain of the trustees.
Please note that the trustees who shall fail to comply with this notice risk being dissolved immediately after the expiry of the said notice period.
